Terms of Service

These terms are the agreement between you and He Planned. By creating an account or using the service you accept them. If you do not accept them, do not use the service.
1. You must be 18
The service is for adults only. You confirm you are at least 18 years old and legally able to enter this agreement. Accounts belonging to minors will be closed.
2. What the service is — and is not
He Planned produces suggestions. It drafts a run of show, proposes venues and vendors, estimates costs, writes call scripts for you to use, and helps you assemble letters from your own words.
It does not book anything. We are not a travel agency, a ticket seller, a reservation platform, a payment processor for vendors, or an agent for any business named in your plan. We hold no inventory and have no relationship with the businesses we suggest.
Every venue, vendor, address, phone number, opening hour, availability and price in your plan is unverified until you confirm it directly with that business yourself. Businesses close, move, change hands, raise prices, stop offering things, and get booked out. Treat every suggestion as a lead to call, never as a confirmed arrangement.
3. The AI can be wrong
The concierge is an AI system. It can state a price, an address, an opening hour, a menu, an availability or a policy that is inaccurate, out of date, or entirely invented — including claiming a place exists when it does not. It can misunderstand you in a voice conversation. You are responsible for checking anything you intend to rely on, and for reading your plan before you act on it.
4. Unusual arrangements and vendor cooperation
Much of what makes a surprise land is a business agreeing to do something outside their normal routine: holding a table, hiding a note, letting someone arrive in costume, timing a course, taking payment in advance. No business is obliged to agree to any of it, and nothing our scripts say creates any obligation on them.
We do not guarantee that any business will honour an unusual arrangement, that the staff working your actual shift will know about it, or that a manager's agreement will be carried out. Confirm with the people who will be there on the night, and have a fallback.
5. You are responsible for the event
You are solely responsible for all money you spend, every deposit you pay, every contract you sign, every reservation you make and every arrangement you agree to, whether or not the idea originated in this app. You are responsible for the safety and legality of the plan you carry out. We are not a party to anything you agree with a third party and we do not refund what you spend with them.
6. Acceptable use
You must not use He Planned:
- to plan or assist surveillance, tracking, monitoring, stalking, harassment, intimidation or coercion of any person;
- to arrange contact with, or an encounter with, anyone who has not consented to contact with you — including anyone who has asked you to stop, blocked you, or is protected by a restraining or no-contact order;
- to deceive someone into a situation they would refuse if they were informed — a surprise is a delayed reveal of something they would welcome, not consent manufactured by withholding information;
- to plan anything unlawful, or anything intended to threaten, humiliate or endanger a person;
- to enter another person's information in violation of the law or of a duty you owe them, or to impersonate anyone.
We may suspend or terminate an account for any of the above, and the concierge is built to refuse these requests.
7. The reveal step is a product principle
Every plan includes a reveal — the moment you tell her how it came together. We believe the story afterward is half the gift, and we design for it deliberately.
To be clear: the reveal is a product principle, not a legal safe harbour. Including a reveal step does not make an otherwise unwanted, deceptive or unlawful plan acceptable, and it does not shift responsibility for the plan from you to us.
8. Your content and how the concierge uses it
You keep ownership of what you write and dictate. You grant us the licence needed to operate the service — to store your plan, process your audio and text through our model providers, and show your content back to you.
The concierge coaches rather than ghostwrites: it structures and polishes the details you supply, and it will not invent personal sentiment on your behalf. You are responsible for what you ultimately send, read aloud or hand to another person.
9. Plans and billing
Free. Build and view one plan.
Per event — $49, one time. Unlocks the vendor coordination kit, the artifacts workshop and the reminder timeline for that single event. It is a one-time charge for that event and does not renew.
Unlimited — $19 per month. A subscription covering unlimited events and every paid feature. It renews automatically each month at $19 until you cancel. Cancel any time in Settings; cancellation stops the next renewal and you keep access until the end of the period you have already paid for. We do not pro-rate partial months.
Prices are in US dollars and exclude any taxes we are required to collect. We may change prices for future periods with notice before renewal. Except where the law requires otherwise, payments are non-refundable — if something has gone genuinely wrong, email privacy@heplanned.com and we will look at it.
10. Disclaimer of warranties
The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty as to the accuracy, completeness or availability of AI-generated suggestions. We do not warrant that the service will be uninterrupted or error-free, or that any event planned with it will go as planned.
11. Limitation of liability
To the maximum extent permitted by law, He Planned and its operators are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, wasted expenditure, a ruined occasion, or emotional distress, arising out of or relating to your use of the service.
Our total liability for all claims relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars ($100). Some jurisdictions do not allow certain limitations, in which case these limits apply to the fullest extent permitted.
12. Indemnity
You will indemnify and hold us harmless from claims arising out of the information you enter about another person, the plans you carry out, your arrangements with vendors, and your breach of these terms or of applicable law.
13. Suspension and termination
You may stop using the service at any time and delete your account in Settings → Legal. We may suspend or terminate an account that breaches these terms, that we are legally required to close, or that puts another person at risk.
14. Governing law
These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Florida for any dispute that is not otherwise resolved, except that either party may seek injunctive relief where necessary.
15. Changes
When these terms change materially we update the version above and ask you to accept the new version the next time you sign in. Continuing to use the service after that means you accept the current version.
